Terms of Service

These Terms govern your use of the Kusinita app and website ("Kusinita"), operated by Allan Fuerte. By creating an account or using Kusinita, you agree to these Terms. If you do not agree, please do not use Kusinita.

1. What Kusinita is

Kusinita is a peer-to-peer platform that helps buyers find and contact independent sellers of food and produce, such as home cooks, local vendors, and small growers. Kusinita is not a seller, restaurant, food producer, or delivery service. Every sale is a transaction directly between the buyer and the seller. Kusinita is not a party to that transaction.

2. Eligibility and accounts

• You must be at least 18 years old to use Kusinita.
• You sign in with your Google account and are responsible for activity on your account.
• Information you provide on your profile must be accurate, including contact details shown to other users.

3. Seller responsibilities

If you sell on Kusinita, you are solely responsible for what you sell and agree to:

• Prepare, store, package, and handle food safely and hygienically.
• Comply with all laws and regulations that apply to you, including any permits, registrations, or licenses required by your local government unit or national agencies for selling food.
• Describe items honestly, including ingredients and common allergens where relevant, and post accurate prices and any delivery fees.
• Fulfill orders you accept, or promptly tell the buyer if you cannot.
• Arrange delivery yourself if you offer it, including through third-party couriers. Couriers are independent of Kusinita.

4. Buyer responsibilities

• Pay sellers as agreed for orders you place.
• Check item descriptions, and ask the seller directly about ingredients or allergens before ordering if you have dietary concerns.
• Be respectful and available for pickup or delivery as arranged.

5. Payments

Kusinita does not process or hold payments. Buyers pay sellers directly by the method they agree on (such as cash or e-wallet). Kusinita is not responsible for payments, refunds, or disputes between users, though you may report problems to us.

6. Prohibited items and conduct

You may not use Kusinita to:

• Sell alcohol, tobacco or vaping products, drugs, medicines, supplements making health claims, live animals, or anything illegal.
• Sell spoiled, unsafe, or misrepresented food.
• Post false, misleading, offensive, or infringing content, including photos you don't have the right to use.
• Harass, scam, or harm other users, or misuse their contact information.
• Interfere with or attempt to gain unauthorized access to the app.

7. Listings and moderation

We may review, refuse, or remove listings and suspend or close accounts that violate these Terms or put other users at risk, at our discretion.

8. Disclaimers

Kusinita is provided "as is." We do not inspect, verify, or guarantee the quality, safety, legality, or accuracy of any food, listing, or user. You use Kusinita and deal with other users at your own risk and should use your own judgment.

9. Limitation of liability

To the fullest extent permitted by law, Kusinita and its operator are not liable for any loss, illness, injury, or damage arising from transactions, food, deliveries, or interactions between users, or from your use of the app.

You can stop using Kusinita and delete your account at any time. See how to delete your account.

11. Changes to these Terms

We may update these Terms from time to time. Continued use of Kusinita after changes are posted means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Republic of the Philippines.
